Suspended High Court Judge Justice Erica Ndewere has been relieved of her duties as a judge, after a tribunal that was assembled to investigate her conduct recommended her dismissal.

The tribunal which was chaired by Retired Judge Justice Professor Simbi Mubako presented its report to President Emmerson Mnangagwa at State House today.

Other members of the tribunal are lawyers Mr Charles Warara and Ms Yvonne Masvora.
President Mnangagwa, on the strength of the recommendations of the tribunal, pronounced Justice Erica Ndewere dismissed with immediate effect.

In a statement, Chief Secretary to the President and Cabinet, Dr Misheck Sibanda announced the dismissal of the judge with immediate effect.
“The tribunal has presented its findings to His Excellency, the President of the Republic of Zimbabwe, in terms of Section 187 (7) of the Constitution. The tribunal has recommended that the Honourable Justice Ndewere be removed from office for gross misconduct,” the statement read.

“His Excellency, the President, has accordingly, in terms of Section 187(8) of the Constitution, removed Honourable Justice Erica Ndewere from office,” concluded Dr Sibanda in the statement.

Justice Ndewere stands accused of conduct inconsistent with a judicial officer, reportedly for slipshod work and a large batch of delayed judgments.
A tribunal was established on November 19, 2020 to investigate allegations of gross misconduct by Justice Ndewere.
A tribunal is a statutory body whose findings and verdict cannot be contested or appealed, making its findings and recommendations final.
