‘Class monitors’ lose in Wadyajena noise case

The High Court has ruled in favour of Gokwe Nembudziya legislator Justice Mayor Wadyajena in his case against the Borrowdale Brooke Home Owners Association( BBHOA).
The BBHOA have been dubbed online as class monitors, after disabling Wadyajena’s access cards after a difference in opinion.
Wadyajena was being accused making noise in the Brooke with one of his many vehicles late at night.
Wadyajena approached the High Court for remedy after a letter by his lawyers to the BBHOA was ignored.
Justice Never Katiyo ruled in Wadyajena’s favour.
“The respondent (in this case BBHOA) shall immediately restore the Applicant’s (Wadyajena) access to the Borrowdale Brooke Estate by fully reactivating Applicant’s access tags.

The Respondent and it’s employees are hereby interdicted from deactivating Applicant’s access tags without following due process or the authority of a court order. Each party shall bear its own cost,” Justice Katiyo wrote.
The BBHOA is led by Pastor Shingi Munyeza.
